Winspirit Terms and ConditionsIntroduction
These Terms and Conditions govern the use of the Winspirit website and related services (the Service). By accessing the Service, you enter into a binding legal agreement with Winspirit. If you do not accept these Terms, you should refrain from using the Service. The Service is operated by Winspirit and any use is subject to the rules set out herein.
General Terms
Winspirit reserves the right to revise and amend these Terms at any time. Amendments are binding and effective immediately upon publication on the Website. If you object to any changes, you must discontinue use of the Service. Any bets not settled before the new Terms take effect will be governed by the pre-existing Terms.
Your Obligations
- You are over 18, or the legal age for gambling in your jurisdiction, and you may be required to provide proof of age upon request.
- You have the legal capacity to enter into a binding agreement with Winspirit.
- You reside in a jurisdiction that permits online gambling and you are not located in a territory where access to the Service is prohibited.
- You may not use a VPN, proxy, or similar tools that mask or manipulate your real-location identification.
- You are the authorized user of the payment method you use for deposits and withdrawals.
- You will make all payments to Winspirit in good faith and will not attempt to reverse a payment or induce reversals by third parties.
- You acknowledge that bets may result in loss of all or part of your deposited funds and you remain solely responsible for any such loss.
- You will not rely on information obtained in breach of applicable laws when placing bets.
- You act solely on your own behalf as a private individual and not on behalf of any third party or for any commercial purpose.
- You will not manipulate any market or element of the Service in bad faith or in a manner that undermines the integrity of the Service.
- You will act in good faith in relation to Winspirit and the Service for all bets made.
- You are not registered as an Affiliate in any Winspirit Affiliate program.
Restricted Use
- You must not use the Service if you are under 18 or under the legal age in your jurisdiction, or if you lack legal capacity to enter into a binding agreement.
- You must not reside in, or access the Service from, a jurisdiction where online gambling is prohibited.
- You must not access the Service from restricted jurisdictions or engage in prohibited activities including, but not limited to, attempting to exploit or collude with other Customers, or using information to gain an unfair advantage.
- You must not collect or solicit other Customers’ personal data, disrupt the Service, or post unsolicited advertisements or affiliate links.
- You must not attempt to scrape odds or infringe Winspirit's intellectual property rights, or use the Service for unlawful purposes.
- You may not sell, transfer, or acquire a User account from third parties, nor transfer funds between Player accounts.
- Employees, distributors, or immediate family members of Winspirit and related entities require prior written consent to use the Service for real money activities; violations will result in termination of accounts and forfeiture of bonuses and winnings.
Registration
- Winspirit may refuse registration at its sole discretion without obligation to provide a reason.
- Before using the Service, you must complete the registration form, read and accept these Terms, and may be required to become a verified Customer by passing checks including valid identification and proof of residence. Wagering or features may be suspended until information is received, in line with regulatory and anti-money laundering requirements.
- You must provide accurate contact information, including a valid email address, and keep it up to date. Communications from Winspirit are sent to the registered email address.
- You may register only one Account. Accounts found to be multiple or used by representatives or third parties may be closed.
- Winspirit may request additional personal information or use third-party data providers to verify identity. You will be notified of any data obtained.
- You must keep your password confidential and secure. You are responsible for all activity on your Account regardless of third party access. Change your password regularly and notify Winspirit immediately if you suspect compromise.
- Transmitting any screen content or information to other Customers or displaying information in a frame that misleads customers is prohibited.
- Accounts may be opened in multiple currencies as available; balances and transactions appear in the currency of the transaction; some payment methods may not process all currencies.
- Sign-up is an invitation to treat and does not create any obligation to open an Account; Winspirit may refuse to open an account without giving reasons.
- Winspirit may request further information to comply with regulatory obligations and AML requirements.
Your Account
- Accounts may operate across several currencies; all balances and transactions are shown in the transaction currency.
- Winspirit does not extend credit for the use of the Service.
- Winspirit may close or suspend an Account for non-compliance or to preserve the integrity or fairness of the Service; prior notice may not be possible. In such cases, bets may be canceled and funds withheld.
- Winspirit may close or suspend an Account without prior notice and return all funds; matured contractual obligations will be honoured.
- Winspirit may refuse, restrict, cancel, or limit wagers at any time for any reason, including suspected fraudulent activity or attempts to circumvent safeguards.
- If any amount is credited in error to your Account, it remains the property of Winspirit and will be withdrawn when detected.
- If your Account is overdrawn, you owe Winspirit the overdrawn amount.
- You must inform Winspirit of any errors affecting your Account promptly.
- Betting is for entertainment; if gambling ceases to be enjoyable or you suspect loss of control, you may self-exclude by contacting Customer Support via your Registered Email Address.
Inactive Accounts
- If your Account is in credit and has been inactive for twelve consecutive months, Winspirit will apply an Inactive Account Fee of 5 EUR (or currency equivalent) per calendar month.
- You will be notified before the fee starts (from the eleventh month of inactivity) and you may log in to withdraw funds at any time.
- The Inactive Account Fee is withdrawn monthly from a positive balance for the period of inactivity; if the balance falls below the fee amount, the remaining balance will be used to satisfy the fee.
Payment Transactions and Processors
You are fully responsible for paying all amounts due. You must not reverse payments or induce reversals by third parties to avoid liabilities. You will reimburse Winspirit for charge-backs, denials, or reversals and any losses arising therefrom. An administration fee of 50 EUR (or currency equivalent) may be charged for each charge-back, denial, or reversal.
Errors
In the event of an error or malfunction of the system or processes, all bets are void. You must inform Winspirit promptly of any error. Where errors occur due to system or communication faults, Winspirit may void affected bets, and is not liable for direct or indirect costs or losses resulting from such errors.
Rules of Play, Refunds, and Cancellations
- The winner of an event is determined on settlement; protests or overturned decisions will not be recognized for wagering purposes.
- All results posted are final after 72 hours. Within 72 hours, resets or corrections may occur due to human error, system error, or errors from the result source.
Communications and Notices
- All communications from you to Winspirit shall be via the Customer Support form on the Website.
- All notices to you from Winspirit will be posted on the Website or sent to your Registered Email Address. The method of communication is at Winspirit's sole discretion.
Security and Privacy
Winspirit employs industry-standard encryption for usernames, passwords, and other sensitive information. Access to the Service requires a secure login, and you must keep your credentials confidential. You are responsible for all activity under your Account and for maintaining the security of your Registered Email Address. Personal data is handled in accordance with the Privacy Policy published on the Website, which may be amended from time to time. Winspirit may disclose certain information to authorities as required by law or regulatory obligations, including to investigate money laundering or fraud, in accordance with applicable laws and the Privacy Policy.
Matter s Beyond Our Control
Winspirit will not be liable for any failure or delay in providing the Service due to an event of force majeure, including acts of God, strikes, power failures, government actions, or telecommunications interruptions. In such events, Winspirit may cancel or suspend the Service without liability.
Liability
To the extent permitted by applicable law, Winspirit will not compensate for reasonably foreseeable losses arising from failure to meet obligations under these Terms, except where such failure causes death or personal injury through negligence. Liability is limited to direct losses caused by Winspirit's breach and excludes business losses. Winspirit's liability may be excluded or limited where prohibited by law.
Gambling By Those Under Age
If Winspirit suspects that you are under 18 (or under the age of majority in your jurisdiction) when you place bets, your Account will be suspended pending investigation. If underage gambling is confirmed, winnings may be retained by Winspirit, deposited funds may be returned at Winspirit's discretion, and related costs may be recovered.
Self-Exclusion
If you wish to self-exclude, submit a request using your Registered Email Address to Winspirit's Customer Support. Upon acknowledgement, self-exclusion will apply for the period requested and gaming activity will be restricted during that period.
